I was driving down on Ernakulam – Trissur highway on my way to trek Valpara forest on the last weekend along with my friends in a different car. A tipper truck that was in front of me never gave way although I flashed and honked for about 2 minutes on the first lane where the fast moving vehicles are suppose to travel. The truck driver seemed not ready to move at all although there were no vehicle blocking his traffic in front or left lane. Having noticed a free flowing left lane, I was forced to move to the left lane I could easily pass over. But, the truck occupied the left lane a bit as we passed a small curve to the left and nudged on my car on the rear right hand side that caused my vehicle to swirl. The truck rammed onto the median and thrashed a traffic post on there and came back onto the road, thrashed my car once again and rendered another swirl. Luckily, I and my friend survived the accident without any injuries although we swirled three times, hit three times and smashed onto the median.

There has been a very bad record for the tipper trucks and buses in Cochin to have caused and involved in so many accidents of which mostly are fatal. Authorities have never woken up and taken any preventive and strict measures.

Driving on Cochin roads a sort of nightmare where no lane discipline is followed; not made to adhere by the police. You got to be a circus article to be able to reach your destination safely. Big vehicles such as trucks and buses usually take the first lane although they’re at very low speed. This not only cause to increase the traffic congestion, but also causes incredible delay for one to reach a overfar destination.

Legislations has to be made to book the offenders with imprisonment and heavy penalties along with barring driving license etc depending on the seriousness of the offense where was the cops are busy hailing the bikers who didn’t wear helmet and car drivers who didn’t wear seat belts which are end of the day causes only their personal life.

In Iran, the semi-official Mehr news agency declared: “The death of Osama is a lie.”

Iranian state television news said by disposing of the body at sea, “the mystery (of his death) has increased.” Iranian media say the myth of bin Laden has been used to justify the U.S. occupation of its neighbor, Afghanistan.

Nearly 3,000 people died when planes hijacked by bin Laden’s al Qaeda followers flew into the World Trade Center, the Pentagon and a field in Pennsylvania on Sept. 11, 2001, setting off a hunt for the plot’s architect.

Afghanistan’s Taliban said in a statement posted on their website that talk of bin Laden’s death was “premature” and that the United States had not provided “convincing evidence.”

Retired teacher Joani Ellingson, 62, who was visiting from Minnesota, said: “It is part of the death culture that we want to see proof positive. We have a curiosity.”

Rosaleen Tallon, whose brother died in the attacks on the World Trade Center, said she was “dismayed” that bin Laden was buried so quickly.

“It has unfortunately opened this up to the possibility of conspiracy theories,” she said.

At Pace University, political science professor David Caputo asked students if they doubted bin Laden was dead. Two thirds had at least a slim doubt, and 5 percent had a major doubt, he said.

This is a rebut to Barkha Dutt’s (who I really look up to) documentary ‘The Women in Tahrir Square’. I absolutely disagree with her prejudiced arguments when it comes to Islam and women in Islam which I firmly believe that it’s out of her total ignorance of Islam. This points towards the entire media fraternity who tend to annul the positives of Islam and Muslims while exaggerating silly errors committed by Arabic named wicked followers.

I really look up to Barkha for her explicably enviable journalistic expertise and the works she did so far. I was even named her Advocate off the article I wrote defending her in the Radia tape controversies.  Bigots, Patriotics and traitors – Identity crisis? I just wanted to convey that there is nothing personal, but against her purport this time.

It’s totally out of proportion that Barkha didn’t manage to find even a single woman in Hijab out there who was protesting against Mubarak!!! One can interpret it to be total conspiracy or a silly incidental mistake where I would not buy the latter.

Islam does not oppress women in any matter, so is Hijab. Its very purpose is to ensure her protection through modesty. Islam doesn’t not enforce any rule in Islam, it’s up to the person to follow or not. If he doesn’t follow the instructions, he would be caught on the day of judgement is all. If someone is compelling someone to wear it or doff it, that’s against Islamic principle itself.

Why would you have a problem if a woman chooses herself to wear Hijab? There are enormous number of women who’re very successful around the globe who voluntarily choose to wear Hijab. It’s so ludicrous to argue that wearing a Hijab itself would render a female in the backseat which is contrary to any logic and intellect. This is an absolute megalomania.

Media (wicked) debates always carry some female to represent Islam who has got to connection with Islamic way of life other than of her involuntarily availed name off her birth. This is purely of the intension to malign Islam and Muslims. Islam clearly defines who’s a Muslim; one who adheres to Qur’an and Sunnah is called Muslim. One doesn’t not become Muslim because of his birth to Muslim parents, name, ancestry, etc.

Islam always purported and the history would testify the argument to be true that Islam always suggested an unbiased rule and that holds the ruler accountable for the shortcomings. You mentioned Muslim Brotherhood in Egypt to be a terrorist group. Fair enough if you would agree RSS/MNS etc are similar terrorist group too as they purports India to be a Hindu country. Muslim Brotherhood is as legal opposition as RSS and MNS, etc are in India is all about it.

Blasphemy laws in many countries invoked notoriety towards Islam which is contrary to its principle itself. It’s undoubtedly against Islamic perspective to harm the person who blemished Islamic ideology, Prophet(s), Qur’an, etc. Forgiveness is what Islam teaches. Prophet Mohammed’s (Peace Be Upon Him) companions stomped to kill a Christian man who peed in the Masjid where Prophet Mohammed (PBUH) asked them to exert patience and suggested them to flush there so that the pee gets cleared off. I would suggest those militant Muslims(?) and critics to study Prophet(PBUH)’s history where the time before the prophecy, Hijra (flee to Madina) until the first war ‘Badr’. You would learn the magnitude of patience exerted by Rasul (PBUH) and he purported patience. Prophet (PBUH) went ahead said “Patience is half of faith.”

Islam has not asked to chop the blasphemer. Pak’s occurrence off blasphemy law of late has found place in headlines. The news reflects that Islam purports death sentence for blasphemy; also reported that contemptuous words and deeds against Prophet Muhammed(PBUH) comes under blasphemy perspective.

This is absolutely contrary to the fact. Contempt of Prophet is misuse of freedom in Islamic perspective though; not unforgivable sin. Neither the contemptuous person is not entitled to any punishment nor any proof supporting the punishment be found in testaments. If anyone has used any scornful words against the Prophet, a Muslim is expected to view it as a misunderstanding is all. The primary responsibility of a Muslim to debate or admonish such people to convince them of Islam and do about erasing the misunderstanding they have of the Prophet.

There must be a reason by which Micheal H Heart chose Prophet Mohammed (PBUH) to be the most influential person in the world.

I would like to add with respect to an edition of ‘We the People’ where Dr Zakir Naik was invited too. It’s absolutely objurgated if the terrorism promoted by Osama bin Ladin as shown on media and it’s totally against Islamic perspective. Nonetheless, most of the arguments against him are not corroborated so far and there is a massive media campaign against Islam being a pretext to some American conspiracies as analyzed by American experts themselves. Subject: Memorandum on Amendments of IPC 498A Honorable Members,

I would like to present this memo with reference to the invitations in support of the  petition praying for amendments in Section 498A of Indian Penal Code, 1860. I wholeheartedly support the petition which points to the extensive abuse and misuse of this provision of the Penal Code, which occurs on a daily basis.

Current IPC 498-A498-A.

Husband or relative of husband of a woman subjecting her to cruelty

Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to  three years and shall also be liable to fine.

Explanation- For the purpose of this section, “cruelty” means-

(a) any wilful conduct which is of such a nature as is likely to drive the woman to commit  suicide or to cause grave injury or danger to life, limb or health (whether mental or  physical) of the woman; or

(b) harassment of the woman where such harassment is with a view to coercing her or  any person related to her to meet any unlawful demand for any property or valuable security or is on account of failure by her or any person related to her to meet such demand.

498-A is cognizable, non-bailable, and non-compundable. Arrests are made, without any preliminary investigations. Statement of wife is treated as gospel truth.

The provision of IPC 498A was inserted in the Indian Penal Code by reason of The Criminal Law (Second Amendment) Act, 1983 (Act No.45 of 1983). The statement of objects and reasons thereof reads as under :-

“The increasing number of Dowry Deaths is a matter of serious concern. The extent of the evil has been commented upon by the Joint Committee of the Houses to examine the working of Dowry Prohibition Act, 1961. Cases of cruelty by the husband and the 1 of 6relatives of the husband which culminate in suicide by, or murder of, the hapless woman concerned, constitute only a small fraction of the cases involving such cruelty. It is therefore proposed to amend the Indian Penal Code, the Code of Criminal Procedure and the Indian Evidence Act suitably to deal effectively not only with cases of Dowry Death but also cases of cruelty to married woman by their in laws.”

Though, IPC 498A was enacted with the main objective of curbing, dowry deaths, in majority of the cases, where it has been used, not even a whisper of demand of dowry is there, or any physical injury is present.

Clause A of 498A, which deals with physical and mental abuse is dealt with in a very comprehensive manner under The Protection of Women from Domestic Violence Act, 2005, (PWDVA). Clause A of 498A is very vague, and is very wide open for any interpretations. And where wide interpretations are possible, misuse becomes rampant. PWDVA provides a better definition of Domestice Violence, and hence renders 498A infructous. In majority of the cases, baseless allegation of physical cruelty are made, even though, no physical injury exists. With no procedure, to curb false allegations, exaggerated complaints with malafide intentions have became the norm.

Clause b of IPC 498A, covers the demand for dowry. The Dowry Prevention Act,1961 was enacted for this sole purpose, and looking at the mis-use of 498A(98% acquittal) it is very clear, that clause B of IPC 498A has failed miserably. This also underlines the fact, that the sole purpose of invoking 498A is to harass husband, and his relatives. Further IPC 406 is used for further safeguarding of streedhan. Hence overall IPC 498A is useless in todays circumstances. The high number of quashed 498-A cases throws enough light, on the way, this section is being heavily misused, to harass husbands and his relatives.

By treating the statement of wife as gospel truth, arrests are made, without any opportunity being given to the accused husband, which goes against the principle of natural justice.

Rather than effectively implementing existing laws, adding new laws, for issues, for which there are existing legal remedies, creates new problems. Hence the need of the hour is not new laws for marrital issues, but effective implementation of current laws. Since PWDVA provides all the relief to a wife, IPC 498A  has became irrelevant.

The Real Statistics    and Effects of the 498A Misuse

a) Number of false cases has increased by 280% since the last 12 years. From 28579 cases in 1995, it has reached 81344 in 2008(source National 2 of 6Crime Record Bureau, 2008). Almost a million people have been arrested since 1999.

b) 80% of people arrested are found innocent after a legal trial of an average of 7 years. The average length of trial has increased from 7.1 years in 2003 to 7.8 years in 2006. Approximately 98% of cases where 498A(r/w 34) is only charge and the wife is alive are found to be false. Punishment is seen in some cases where section 304B is tagged with 498A where the wife has committed suicide.

c) More than 30% of all bail applications are due to IPC 498A. The biggest beneficiaries of this act are the lawyers who are making make money from innocent people’s misery.

Independent research conducted by the well known NGO Save Indian Family Foundation has shown that the total productivity loss annually due to the false 498A related cases is close to Rs 4000 crores. The Indian youth which could have been productive wastes a significant amount of productive time and energy defending itself against false and frivolous cases.

Few    reactions to section 498A and its misuse

To backlash against 498A misuse has been phenomenal and to cover all of it one letter is impossible, however some notable judgements and  remarks have been covered.

Hon. Supreme Court of India has ordered the Govt to amend 498A many times but to no avail

At the time of delivering the judgment in case of CRIMINAL APPEAL NO. 1512 of 2010, (Arising out of SLP (Crl.) No.4684 of 2009) in the case of Preeti Gupta & Another vs State of Jharkhand & Another, the Hon’ble Supreme Court of India had stated the below  with reference to section 498A and its immense misuse . “Before parting with this case, we would like to observe that a serious  relook of the entire provision is warranted by the legislation. It is also a matter of  common knowledge that exaggerated versions of the incident are reflected in a large number of complaints. The tendency of over implication is also reflected in a very large number of cases”.

“We direct the Registry to send a copy of this  judgment to the Law Commission and to the Union Law Secretary, Government  of India who may place it before the Hon’ble Minister for Law & Justice to take  appropriate steps in the larger interest of the society.”

More such observations regarding 498-A have been made by the Hon. Supreme Court.−

In Criminal Appeal No. 891 of 2004 (Dr. Sunil Kumar Gupta Vs. State of 3 of 6Maharashtra), in point 35, “It is a clear cut case of gross abuse of  dowry laws”

− Appeal (crl) 967 of 2008, M. Saravana Porselvi Vs. A.R.Chandrashekhar & ors, the court has declared “It (complaint) was initiated malafide.”

− Appeal (crl) 1274 of 2008, Ruchi Agarwal Vs Amit Kumar Agarwal & Ors, “In our opinion, the conduct of the appellant indicates that the criminal complaint from which this appeal arises was filed by the wife only to harass the respondents.”

The Hon. Supreme Court, has on many occasions, has came down heavily on wives filing false complaints, and tendencies of prosecution to hastily jump on to the conclusion of husbands being criminal without any material evidence, since it goes against the principle of natural justice. SC has also commented on the unscrupulous wives, filing false 498A complaint, with the only ulterior motive of harassing her husband, and his relatives. Similar sentiments have been regularly echoed by various High Courts across the country.

A sample of such comment, is the below

In Narendar Kumar Vs. State (Govt of NCT Delhi) Cri. Appeal No. 696/2004, Hon. Justice Shiv Narayan Dhingra has commented “ From the entire documents and the testimony of the witnesses I come to the conclusion that it is an unfortunate case where the complainant by making false statement  implicated the entire family in offences of under Section 307 and 498 A IPC.  The Trial Court was not cautious enough to even look to admitted documents on record before convicting the family on mere statement of an estranged wife. Trial  Courts should guard themselves from being swayed by emotions. They should consider entire circumstances and should carefully analyze the entire evidence”

Other notable Legal recommendations

In  Savitri Devi Vs. Ramesh Chand (Delhi High Court, CRL, R462/2002), Hon. Justice JD Kapoor of the Delhi HC passed a landmark Judgement in 2003 against 498A and its misuse .

“Before parting, I feel constrained to comment upon the misuse of the provisions of Section 498A/406 IPC to such an extent that it is hitting at the foundation of marriage itself and has proved to be not so good for the health of  the society at large. To leave such a ticklish and complex aspect of proposition as to what constitutes `marital cruelty’ and `harassment’ to invoke the offences  punishable under sections 498A/406 IPC to a lower functionaries of police like Sub Inspectors or Inspectors whereas some times even courts find it difficult to come to the safer conclusion is to give the tools in the hands of bad and  unskilled masters.”

“There is a growing tendency amongst the women which is further perpetuated by their parents and relatives to rope in each and every relative- including minors and even school going kids nearer or distant relatives 4 of 6and in some cases against every person of the family of the husband whether  living away or in other town or abroad and married, unmarried sisters, sister-in-laws, unmarried brothers, married uncles and in some cases grand-parents or as  many as 10 to 15 or even more relatives of the husband. Once a complaint is lodged under Sections 498A/406 IPC whether there are vague, unspecific or  exaggerate allegations or there is no evidence of any physical or mental harm or  injury inflicted upon woman that is likely to cause grave injury or danger to life,  limb or health, it comes as an easy tool in the hands of Police and agencies like  Crime Against Women Cell to hound them with the threat of arrest making them run here and there and force them to hide at their friends or relatives houses till  they get anticipatory bail as the offence has been made cognizable and non-bailable. Thousands of such complaints and cases are pending and are being  lodged day in and day out.”

“ It is rightly said sometimes the remedies are worse than the perils or disease. Having seen and experienced the enforcement of  these laws for decades, time has come to take stock and review them as  thousands of marriages have been sacrificed at the altar of this provision. In one metropolis alone, thousands divorce cases arising from the cases under Section  498A/406 IPC are pending in Courts. There are equal or more number of  marriages which are in limbo. What else is it if not a social catastrophy ? This should be a matter of concern for social scientists, law-makers and Judges also.”

Government wastes taxpayer money to subsidize a wife’s vengeance

It is now common knowledge in India that over 98% of all cases filed under section 498A are false to begin with. Since a 498A case is a crime against the state, the Indian Govt fights a 498A case on behalf of the wife. Hundreds of crores of tax payer money is wasted in pursuing these 98% of false cases which essentially are wild goose chases for decades. The same taxpayer money which is now used to subsidize a wife’s greed and vengeance can be better used to improve the working condition of the Indian courts and also reduce judicial backlog.

WHO calls 498A as the primary reason for Elder abuse in India

In the report titled “Elder Abuse in India” the world health organisation (WHO) stated “Daughters-in-law” was the next “problem” in both the groups(upper and lower middle class senior citizens). While both the groups stressed on the lack of  caring attitude by the daughters in law, women of the lower socio-economic class got very vocal about the fact that daughters in law were misusing the law, by reporting harassment by in-laws to the police, leading to maltreatment by the police to the in-laws. (Indian Penal Code sec.498(a), is designed to tackle dowry  deaths)”

Ministerial Advisories / Stop Gap measures undertaken

Alarmed at the ever increasing number of false cases and the inaction at the center about changing this law. Local police started issuing advisories agsint arrest without investigations. Also the Central Home Ministry has issued an official advisory in which it stated

“In some cases, every member of the husband’s family has been arrested, irrespective of whether they had a role in inflicting cruelty on the married woman or not. In some cases, the provisions have been used to settle personal scores. Cases have been reported where momentary anger has resulted in invocation of Section 498A, which resulted in the arrest of the members of the family shutting down any possibility of  reconciliation in future and total collapse of the marriage. Even where there is a divorce proceeding, the case under Section 498A continues to persist because of the offence being non-compoundable,” .

Recommendations .

Keeping in view all the above facts, it will be in the interest of justice, that the draconian section 498A of Indian Penal Code be repealed. IPC 498A is clearly unsustainable. It has cause much harm(and is still continuing to do so) to the Indian society, particularly the institution of marriage is threatened by 498A. Growing number of men, are opting to stay out of marriage, for fear of, a false 498A complaint being lodged against them.

At the outset, I clearly don’t face any identity crisis, but some around seriously face the crisis though. I’m an Indian, a very patriotic Indian who strongly believes in democracy in its fullest means and robustness. A true Muslim who has stake in national interest as well as religion. I’m not driven by emotions, but sensible approach in anything I deal with.

Some creed of twitterattis were on their toes this after noon. They not only never seemed to be believing in democracy, religion, social harmony, but the other way around. There has been much going around with Radia tapes where Barkha Dutt and Vir Sanghvi are a couple of the journalists from the lushed number of other journalists caught talking to Nira Radia.

Ever since Radia Tapes came (brought) to light, I could observe some self proclaimed Right Wing Fanatics who propounds a Saffron India annihilating all Muslims (According to their legacy, they must be cleaning up the lower clans who’re not even allowed nearby them to sit with or dine with) ranting against Barkha Dutt as if it’s substantiated she poked the national exchequer. They obviously seemed to have some inclined interests by propounding their agenda by tarnishing Ms Dutt who’s projected to be a ‘Pro Congress’ journalist.

I am neither related to Barkha or Vir nor do I know them personally except some twitter conversation. However, we all know that they’re two of golden idols of Indian journalists genre. Both of them are caught in conversation with Nira Radia who’s a PR consultant by profession who apparently seemed to have done PR for some political parties.

There is nothing new journalists carry out information peddling stringing along with the source or through some other means. Nakeeran Gopal would have been alleged to be from Veerappan‘s gang lest, you may find innumerable example of such information peddling carried out by different journalists. I found no evidence or substantivity as to Barkha or Dutt linked to 2G scam, neither these fanatics ever substantiated.

All what I did was to support anyone who’s raked at with no substantive point. Anybody would step in to defend someone who’s made scapegoat with no validation whatsoever especially when he/she is a noble and honorable person. Would Kasab’s advocate also be accused of connection with LeT? Does that make any sense at all to anyone who has a bit of brain and sense left?

I quite don’t understand really the catch why these self proclaimed (I didn’t allude so)  Right Wing Fanatics blatantly and blindly controvert Barkha Dutt if at all she had been Pro Congress as projected by these bigots in 2G scam. Terrorism of any kind is objurgated irrespective of the color or creed of the terrorist. It’s doubtlessly a social menace. Being a true Muslim who’s expected to be patriotic according to the testament would proclaim that any terror done in some Arabic terms are menace and deserve to justification. Islam teaches that one who kills a person without justification is like killed the humanity. 

If one refers to the history of Indian Independence movement, erudite Indian Muslims had a pivotal role in the Independence motion unlike the RSS who killed the peace advocate Gandhiji. Islam propounds peace, so do other religions too. One should be sensible enough to validate a religion off its teachings, not looking at its ill-learned followers. I would humbly like to call up on the self proclaimed Right Wing Fanatics to study Hinduism from its testaments – Erigveda, Yejurveda and Samaveda (Since apologies if I have spelt it wrongly) before splashing the venom to discord the communal accord.

A falsity would not become truth if majority support the false. Day would not become night if majority claims otherwise. I have very sincere, intimate and treasured non Muslim friends. I don’t see a non Muslim as an enemy though very small minority are anti-Islam (more of anti-Muslim). Count on me being a true Muslim, I would be the forerunner to condemn any terror committed by a Arabic named person. I (true Islam) condemn the hand choppers and bombers to kills innocents. Islam is the only religion that taught the war etiquette very explicitly. Very unfortunate that the Arabic named fanatics don’t even know the basics of Islam.

Doesn’t it matter at all to the journalist fraternity that a prominent journalist is booked in a fabricated criminal charge(s)? It’s very misfortunate that none appeared to be condemning the attack on the press freedom; this is even a case of mere abuse of fundamental freedom being a citizen of this country. Are we backing up to establish is that we’re enormously growing to become a Banana Republic? Why would one see this incident as a personal one? What would it have been if she was a non-Arabic named? Would the media have adopted the same weird attitude?

This was very evident when Hindu Terror groups were proven to be deeply enrooted in India and their conspired/plots terror were exposed. It was very pleasing by Rajdeep Sardesai on CNN-IBN’s side to actually openly used the Hindu terror when a few incidents were exposed. Nonetheless, when Sri Ram Sena’s (sponsored) terror links were exposed in Bangalore, the same CNN-IBN camouflaged and was very sulky at this news. Entire Indian media fraternity buried the story. A bit of research proves that every Indian media giant has Right Wing Hindu creed in there. Hypocrisy personified!

There is nothing wrong at all for the Right wing Hindus to dominate the media which happened just because of the privilege they had over the period of time. Brahmins in India were integral part of the British Administration in India and even in the domains of Muslim rulers. However, it’s very obnoxious to be advocating a particular agenda covering up a true story.

Even a prominent daily ‘Mathrubhumi’ in Malayalam carried the story depicted it in the most absurd manner instead of signifying the journo was caught. It just neutralized it to five were booked that shows the ulterior motive to malign a creed of the society for a sin that’s actually not advocated. This is a well conspired agenda by Right Wing Fanatics in India and west; certain section of the Brahmins in India and Jews in the west. There are even allegations that RSS has assimilated strategic support from Nazis and MOSSAD is funding RSS. SM Mushrif, an ex-Inspector General of Police in his book ‘Who Killed Karkare?” corroborates it.

This is an explicit example of Islamophobia just because of the name of the indicted journalist. Funniest matter of the fact that Shahina herself had made it clear that “The heaviness of a Muslim name could make life miserable in Delhi. No matter whether you follow religion, religion will definitely follow you” in her column in Hindustan Times.

It has been a growing trend internationally to disregard anything that sounds/seems related to Islam without actually verifying the veracity of the matter. Many Sikhs were maltreated/attacked and or even lynched a few occasions. None of these attackers paradoxically know anything about Islam and most of the time not even acquainted a single Muslim around. Mr Nazeem Hussain presented himself as Uncle Sam and has beautifully exposed the silly Islamophobia through phenomenally humorous manner.

Reiteration: Islam advocates peace and denounce any sort of violence. It’s unfortunate and paradox that ‘Muslims’ (meaning contradicts – better use Arabic named human beings) are largely indulged in terrorism of different kind no matter whatever the reason be. Would you (India Media Giants) be audacious enough to condemn that terror advocated by the Right wing fanatics? It’s a question of propriety and genuineness. A Muslim is one who adheres to the doctrine that’s Qur’an and Sunnath (Prophet Mohammed’s narration and deeds). One doesn’t become Muslim just because he was born to Muslim parents or carries an Arabic name. Terrorism absolute contrary to Islamic perspective.

Nonetheless, being the broader perspective, it’s absolutely against the press freedom and fundamental freedom of expression the Constitution entitles us!!! There are different angles to look at this story. Has the state adopted a modality of suppressing anyone who goes against its standpoint beyond the entitlement of freedom to expression? Indian constitution entitles its citizens of the freedom of expression as long as it is not anti-national, so does the freedom of press. Paradoxic to this, A Tehelka journalists has been booked under section 506 IPC just because she interviewed a couple of witness in Madani’s case. BJP propound Hindutwa and its mother/sister department RSS is astute in their strategies over the years to establish their agenda. Mind you, The Chief Minister of Kanataka Mr Yeddyurappa is a veteran RSS leader in th state. This has been their mode of operandi in BJP led states; perusal of history would testify it.

There has been a gross human right violation when one is accused in India until the adjudication. The unprecedented time the legal proceedings take is hilarious and that itself is the biggest cruelty and torture against the accused in case he/she is innocent. No court or Govt would compensate for enormous the trauma one accused would go through. I myself can testify it as I’m the prime accused in a fabricated 498a case where the authorities are still drowsy from making the inevitable amendment despite of the blatant abuse of the sections. It’s highly vital to speedup the judicial process in order for people to keep their faith and trust in the judiciary. False suits would only darken the muck and make it further snailing.

Blink: Being a Muslim, I seriously objurgate Madani’s (perhaps earlier) stand he had adopted in the context of Babri Masjid demolition that led to a gigantic polarization in Kerala in terms of the religious harmony. It’s not only contrary to Islamic perspective explicitly, so is it against democratic perspective too. His then naive and emotional stand has caused unprecedented divide in the society as it adversely affected the communal harmony than ever.

Let us look at his case in a different perspective at all. He was incarcerated for several years related to the Coimbatore blast case and exonerated eventually as the prosecution perhaps failed to corroborate or it was false false allegation. God knows!! Justice delayed is justice denied. Madani was not even submitted his charge sheet for years together that itself shows the scorn. Why would the police arrest someone is there is no primafacie evidence? If there is a Prima Facie evidence, it wouldn’t be so hard to prepare a charge sheet,

Verdict: Democracy is undoubtedly phenomenal that is not going to be strengthened without citizen’s participation.  Terrorism a social menace despite of its color and creed that needs to be abolished, so does Saffron and Muslim terror. As per news paper reports DIVORCE RATES have increased many-fold in the last two decades marking 600 percent rise in Kerala and Delhi termed as Capital. 66 percent of American divorces are initiated by women, while it rises to 80-85 percent in India. As an extremely concerned citizen of India I’m bringing up the matter to your kind attention so that, you as a responsible member of the parliament can make better decisions for greater governance.

Though I endorse the importance of women empowerment I strongly disagree to blindly follow, by choice or under pressure, the western policies designed by and for the industrialists. Probably you are not aware that most major women organizations in America were funded by Rockefeller Foundation who claims in their website, “By funding a strategic mix of organizations, institutions, and projects; the Foundation is fostering smart globalization.” Most feminist “Women Studies” funding comes from big foundations like Rockefeller Foundation, Ford Foundation, Carnegie Foundation etc and of course USAID, UNIFEM and UN.

While trying to recruit Aaron Russo to CFR (Council on Foreign Relations), Nicholas Rockefeller told that his family foundation created women’s liberation using mass media control. I would recommend you to do some study on CFR and TC (Trilateral Commission) and also the international bankers like Rockefeller and Rothschild family to understand their power and how evil they are. To keep the long story short, they are the master brain behind CFR, TC, EU, “Builderberg” etc. Reports say, this secret society’s ultimate aim is to establish a “New World Order” to enslave the global population.

Behind the façade of “women’s rights”, Feminism teaches that heterosexual roles (wife, mother etc) are socially constructed by MEN and oppressive to WOMEN. • They are 9 times more likely to drop out of school
• They are 20 times more likely to end up in prison.
• They are more likely to have behavioral problems or run away from home.
• They are more likely to become teen parents

Indoctrinating the whole generation using mass media with absurd and ludicrous ideologies crafted by and for the industrialists, coupled with draconian family laws, it has almost become impossible for a man to live with a woman in USA. The outcome is more spending and more tax revenue. Watch MTV program “Sixteen and Pregnant” to understand the real state of affairs of the so called empowered liberated women in America. Most states in USA do not even reveal the real statistics about divorce! Apparently, the Census Bureau, too, is planning to incorporate broader definitions of family when measuring poverty, a shift caused partly by recent jumps in unmarried couples living together.

I know Indian situation cannot be compared with USA but my point is, it’s only a matter of less than 15years to get there, if we follow the same path. Indian media has already started trying its best to bring social acceptance for live-in relationships by publishing misleading reports of Supreme Court judgment and by highlighting film stars who live together without marriage, as role models. People are aware that India government has not started keeping records of divorce yet, but we know it from the statistics of existing draconian laws, that how many families are getting broken down every year. This is based on the number of cases registered under section 498a of IPC and the fact of the matter is that in each of these cases there is an AVERAGE of 5 accused and the RANSOM asked AVERAGES TO 30 LAKHS!!!

Note that these graphs do not include any of the cases filed under Domestic violence Act or various other maintenance laws. There is no need to emphasis that once the court room enters bedroom, that’s the end of the marriage. In India more MEN are committing suicide due to family problems than women, with an alarming rate of 65:35 (Men : Women) [Source: NCRB]. This might appear appealing to those who believe it is women empowerment; but they fail to understand that this way of marginalizing men through one sided laws will soon, rather than later, force men to back off from running a family to avoid legal, mental, social, physical and financial harassment and also for the well being of age old parents.

Pattern is pretty much the same as it was implemented in the USA; enacting highly discriminatory laws against men, huge incentive for breaking the marriage in the form of alimony child support maintenance etc, media getting paid to give social acceptance for live-in relationships! The message is loud and clear and the master brains are essentially the same and we know how deep the rabbit hole is. All I want to ask you is that, do you have the courage and will power to disrupt dismantle and destroy this industrialist game plan, so as to Save Indian Family and uphold the real essence of democracy?

Today is international men’s day and I’m requesting answers from you for 10 questions

• Women get equal education and more privileges than men. Then why are husbands legally forced to carry wives and even previous partners financially?

• If husband ask money from wife it is termed as dowry and has made a crime. Why is it called Alimony and has made a ‘right’, if wife does the same?

• Adultery is legal for wives; Why are men jailed for the same act?

• If mother takes away kid, courts say kid needs mother. Why are fathers jailed for child abduction if he does the same?

• If women dress like hookers, its liberation; If men show any sort of slightest sexual interest why is it called sexual harassment?

• Why are men taxed more than women for the same pay?

• Why are men banned from contesting in panchayat/municipal elections in certain constituencies?

• Why men are denied protection under Domestic Violence Act and Sexual Harassment at workplace Bill?

• Why do we hear ONLY about 8,000 legally PRESUMED dowry deaths per year, but not the soaring maternal mortality rate of 540 per 100,000? (China=55, Srilanka=60, USA=8)

• Why do women child and animals have ministries but not one for men?

As a citizen of India I here by put forward the following demands for your kind consideration:

1. All the general laws and special acts be made gender neutral in true compliance with Article 14 of The Constitution of India to establish equality before law, including but not limited to, Protection of Women from Domestic Violence Act (PWDVA) and Sexual Harassment at Workplace Bill. All occurrences of word “he/she” be replaced with “person” and all occurrences of word “wife/husband” be replaced with “spouse”
2. Implement complete judicial reforms including but not limited to make erring judges accountable.
3. Establish National Commission for Men and boys
4. Establish Ministry of Men and family Development.
5. Remove the ban on men to contest in panchayat and municipal elections that has been imposed in certain constituencies so as to maintain free and fair elections, one of the basic principles of democracy.
6. Repeal or amend outdated and socially unfit laws. The following are some of the suggestions:-
